Dear Homeowner:

 

For a long time, many homeowners here in the complex have been extremely interested in obtaining cable television service. It appears that now it may be possible, but only if a few conditions are first met.

 

Up until this time, the cable company did not want to install "cable", in our complex, due to the high cost of (our) underground utilities. A few weeks ago, I received a letter from Dimension Cable which outlined some options we now have if we really want "cable". Due to our CC&Rs, it appears that only one of their options is available for us to even discuss and decide on. It is as follows:

 

"Dimension Cable installs all internal wiring and necessary electronic equipment (including a tie to Dimension's existing cable plant) and provides cable service to the residents on an individual basis. Under this option, Dimension Cable would require a one‑time capital contribution from the homeowner's association of approximately $4600. Prepayment of capital contribution installation charges would be required prior to the start of construction.''

 

The CC&Rs in Section 3.2(a) "Common Elements‑Alteration and Improvement" say that "there shall be no alterations or further improvement of common elements without‑the approval in writing of the record owners of not less than 20 apartment units and which does not interfere with the rights of any owners without their consent, may be done if the owners who do not approve are relieved from the cost thereof. The amount of any cost not so assessed shall be assessed to the approving apartment unit owners in equal amounts. All apartment unit owners shall own a full 1/38 interest in the common elements which are altered or further improved, whether or not the apartment unit owner contributes to the cost thereof.''

 

Therefore: if 20 units or more want it, they will split the $4600 cost among themselves, but everyone will be able to hook up after completion. (The initial cost divided 20 ways is $230 each.) The more units that approve and pay for it, the cheaper that this initial cost will be. But remember. you will pay the regular monthly cable charges if you use it

 

However, before any construction can begin, we will need: 1) the approvals of at least 20 units in writing, and, the total installation cost of $4600. If "cable" is approved, the "yes" voters will then be contacted about their share of the installation payment.
