SPECIAL Board Meeting 1/17/89

To review Donna Krepak's satellite dish problem

 

Attending: Lynn Knode, Suzanne Bracker, Marie Martel, David Goode ,Betty Knode, Carmen Olszewski and Donna Krepak.

 

The Board decided to hear what Donna had to say, then hold the Board discussion after she and Carmen had left.

 

Donna claimed that she could not afford to remove the antenna and move for 6‑7 months. Since no form of shielding was acceptable, she admitted that the only recourse that would suit her was to plan to move. She also offered to pay a "fine", which was turned down. That was not a solution to the problem (violation of the CC&R's).

 

David brought photographs that he took from several viewpoints through­out the complex to demonstrate how the large satellite dish dominates the view.

 

The Board discussed the long-range ramifications if the satellite dish were to remain atop the unit at 5823 and decided that the complex cannot afford to allow others to follow suit because the dish is already there. So, it was decided unanimously to notify Carmen and Donna that the satellite dish must be removed within 30 days, whether Donna can afford to move or not. It was further decided that it was only fair to extend the deadline to others who were notified of visible antennas to the end of February too.

 

Marie will discuss this decision with attorney to discover our options in enforcing this decision. She will then notify Carmen and Donna by Letter.

 

1/19/89 Marie talked to Gary Katz, attorney about the Board's decision regarding the satellite dish. He advised that rather than have the dish removed, we should notify the owner of the unit that if the dish wasn't removed within the prescribed time, that the Association would have to consider filing a lawsuit for blatant violation of the C C & R's.
