Minutes for Board meeting on April 27, 1993. Attending were: Terry Roberg, Cleo Crimmins, Suzanne Bracker, Paul Phillips, Walt Fedourich, Marie Martel, Sherry Mara and guest Agnes Woodworth.

Treasurer’s report was given. Delinquent dues were discussed again and it was decided that Suzanne will file with Small Claims Court on behalf of the Association for unpaid dues from 5826. It was also decided to file a lien against 5837 if delinquent dues are not promptly paid. 1992 income taxes have been filed and paid, as have incorporation papers with the Corporation Commission.

Paul will contact an attorney about price estimates to initiate and monitor water shut-offs to those unit owners who do not pay their dues in the prescribed timeframe.

Bids for block work for next building on improvement schedule were reviewed and Lance Construction's bid of $1540. was okayed. There will also be two wrought iron gates required. Terry will get competitive bids. Paul and Walt will get bids for the painting.

There was a lengthy discussion of how to maintain the integrity of our complex and how to end the breaking of the estab­lished rules, which were adopted for the common good. A suggestion was made to levy fines for rules infractions as a method to control the situation.

Terry researched the C C & Rs to locate the passages that pertain to rules. Paragraph 2.3 states: No nuisances shall be allowed upon the condominium property, nor any use or practice which is the source of annoyance to residents or which interferes with the peaceful possession and proper use of the property by its residents. Paragraph 2.6 states: Reasonable regulations concerning the use of the condominium property may be made and amended from time to time by the Board of Directors of the Association. Paragraphs 2.7 through 2.12 state: The following items shall not be permitted on the property: clotheslines, no visible outside antennas of any type, no animals except dogs, cats or other household pets, no advertising signs. Any and all boats and campers mounted on trucks shall be kept covered and in parking spaces or garages and are specifically restricted from parking on the streets and common elements. Trailers and trucks in excess of 3/4 ton shall be completely prohibited. All equipment shall be kept only in the apartment, garage or patio. No sound equipment shall be placed on walls between apart­ments.


The By-Laws, Article VII Section I Paragraph a. state: The Board of Directors shall have power to adopt and publish rules and regulations governing the use of the common area and facilities, and the personal conduct of the members and their guests thereon, and to establish penalties for the infraction thereof.

The regulation regarding parking in the fire lanes is mandated by the Fire Department.

Paul will contact several other condominium associations and ask for their solutions to rules infractions and their fine sched­ules. We will then decide our own approach to solving these problems.

This is a Maricopa County Health Department law and it MUST be obeyed or they will close down our pool. Do not take your dog inside the pool enclosure for any reason, anytime.
